These terms apply to all contracts between Muhammed Ali Bilekkaya, Holunderweg 3, 74199 Untergruppenbach, Germany (hereinafter “IndikatorLab”) and its customers concerning the products Aureus, Velox, coaching and custom-developed indicators.
A consumer is anyone who concludes the contract for purposes that are predominantly outside their trade or self-employed profession. A business is anyone acting in the exercise of such an activity. Deviating terms of the customer only apply if IndikatorLab expressly agrees to them in text form.
IndikatorLab develops and sells technical analysis tools for the TradingView platform. The indicators visualise certain market structures and possible trading zones on the chart according to fixed, programmed rules.
IndikatorLab provides no investment advice, no investment brokerage, no portfolio management and no tax advice. No client funds are accepted, no accounts or securities accounts are managed and no orders are executed. The customer decides on every trade and the capital used on their own responsibility.
The presentation of products on this website is not a binding offer but an invitation to make an enquiry. No binding orders can be placed via the forms on this website; they merely open the customer’s email program.
The customer sends an enquiry to IndikatorLab by email or another channel offered. IndikatorLab then makes an offer with a description of the service and the price. The contract is concluded when the customer accepts this offer in text form. IndikatorLab confirms the conclusion of the contract by email and provides these terms and the withdrawal information in a storable form.
The prices stated in the respective offer apply. All prices are total prices. IndikatorLab is a small business within the meaning of § 19 UStG, so no VAT is shown.
Payment is made, at the customer’s choice, by bank transfer to the account stated in the offer or via PayPal. For Aureus and Velox the amount is due before provision. For custom-developed indicators the amount is only due after completion and approval by the customer (§ 8).
The indicators are provided via the TradingView platform. After payment is received, the customer tells IndikatorLab their TradingView username, after which their account is granted access. Access is usually granted within a few days.
TradingView is an independent platform of a third-party provider. The customer needs their own account for it, which is subject to TradingView’s terms. IndikatorLab has no influence on the availability, features or continued existence of this platform and does not owe its availability. If provision via TradingView becomes permanently impossible, § 7 (3) applies.
The customer receives a simple, unlimited-in-time, non-transferable right to use the respective indicator themselves.
In particular, passing on, publishing, renting or reselling the indicator or its source code, sharing access data and making it available to third parties are not permitted. It remains permitted to show the indicator in your own content, for example in videos or presentations, as long as neither the source code nor access is passed on.
Access is not time-limited and not designed as a subscription. There are no further costs after the one-time payment.
Updates and improvements to the purchased indicator are included at no extra cost as long as IndikatorLab offers the product. There is no entitlement to specific new features.
Should IndikatorLab cease operations or permanently no longer be able to provide access via TradingView, every customer who purchased the indicator will receive, on request, the source code of the indicator they purchased for their own continued use. The restrictions on passing on and reselling under § 6 (2) continue to apply to this source code.
The customer describes the desired strategy and features. IndikatorLab implements them and presents the result. The customer can request changes until the result meets their expectations. An obligation to pay only arises when the customer approves the result. If the customer does not approve it, no paid contract is concluded and no costs arise.
Upon full payment, IndikatorLab transfers to the customer the exclusive and transferable rights of use to the indicator developed for them, including the source code. The customer may use, modify, pass on and resell this indicator.
IndikatorLab remains entitled to keep using general programming techniques, building blocks, libraries and basic functions that do not reflect the customer’s individual strategy, including in other projects.
Scope, price, number of revision rounds and the handling of later extensions are set out in the respective offer. Errors in the delivered indicator are corrected free of charge.
The coaching teaches how the respective indicator works, the underlying rules and how to interpret the setups shown. Scope, number and length of sessions are set out in the respective offer.
The coaching is not individual investment advice. No recommendations tailored to a participant’s personal circumstances are given on individual trades, position size or capital to be used.
Coaching requires purchasing the respective indicator. The coaching customer may show and explain the indicator in their own training, community or company sessions and hold their own sessions about it. Passing on the indicator, its source code or access to participants or other third parties is not permitted. Participants who want to use the indicator themselves purchase their own licence from IndikatorLab.
Agreed sessions can be rescheduled free of charge by either side up to 24 hours in advance. If the customer does not attend without cancelling, the session counts as delivered.
The customer provides the information required to deliver the service, in particular a valid email address and their TradingView username, and keeps it up to date. IndikatorLab is not responsible for delays caused by missing or incorrect information.
Consumers have a statutory right of withdrawal. Details, conditions and exceptions are set out in the withdrawal information, which forms part of these terms.
The statutory provisions apply, for digital products in particular §§ 327 et seq. BGB. If an indicator does not have the agreed quality, the customer is entitled to subsequent performance and, under the statutory conditions, to a price reduction or termination of the contract.
There is no defect if an impairment is due to a third-party provider such as TradingView changing or discontinuing its platform, data feed or programming interfaces, or to the customer using the indicator outside the agreed conditions of use. In such cases IndikatorLab will make reasonable efforts to adapt it.
The absence of a particular trading result is expressly not a defect. No particular hit rate, return or profit is owed or promised.
IndikatorLab has unlimited liability for intent and gross negligence, for injury to life, body or health, for fraudulent concealment of a defect, to the extent of any guarantee given and under the Product Liability Act.
In cases of simple negligence, IndikatorLab is only liable for breach of essential contractual obligations, meaning obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the customer may regularly rely. In this case liability is limited to the foreseeable damage typical for the contract at the time it was concluded.
Otherwise, liability is excluded. Mandatory statutory liability provisions remain unaffected.
For clarification: IndikatorLab gives no guarantee of particular trading results, profits or price developments. The customer makes trading decisions on their own responsibility. Within the scope of the preceding paragraphs there is no liability for losses resulting from such decisions.
Trading currencies, metals and leveraged financial instruments involves considerable risk and can lead to the total loss of the capital invested. Past results or historical tests allow no reliable conclusion about future results. The customer should only use capital they can afford to lose.
IndikatorLab does not broker trading accounts, has no referral or partner arrangements with brokers and receives no commissions from brokers. The customer chooses a broker themselves.
Information on the processing of personal data can be found in the Privacy policy.
For a contract already concluded, the version provided at the time of conclusion applies. Changes to these terms do not apply retroactively to existing contracts.
The law of the Federal Republic of Germany applies. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.
If the customer is a business, a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered location of IndikatorLab. The statutory place of jurisdiction for consumers remains unaffected.
Should any provision be invalid, the validity of the remaining provisions remains unaffected.
